CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 2016. a contract to which the Carriage of Goods by Sea Act 1926 applies has the meaning assigned to that expression in that Act; a contract to which the Merchant Shipping Act 2002 applies has the meaning assigned to that expression in that Act. The Contracts (Rights of Third Parties) Act 1999 (CRTPA) creates an exception which mitigates the harshness of this rule. Where a contract confers a benefit on a third party, that party may acquire the right to sue. It is important for businesses to be aware of CRTPA since it can give rise to sometimes unexpected legal risks, and can even prevent the rescission or alteration of a contract without the consent of persons who are not parties to the contract.
